   5. If, having requested additional information, we are still not able to identify you, we may refuse to act on your request.

4. Whose Personal Data We Will Not Process?

   1. We are not processing your personal data if you are from the United Arab Emirates (UAE) or the United States (USA). We determine your country via IP address and, following this, we limit your access to the Game.
   2. It is impossible completely excluding the situations when the accidental personal data processing of users from the United Arab Emirates (UAE) or the United States (USA) may occur. If this happens, you should contact us via details mentioned in clause 3.1 of this Privacy Policy, and we will promptly erase corresponding data from our servers and inform our partners about it.
   3. Please note that we accept no responsibility regarding the accidental processing of personal data belonging to users from the United Arab Emirates (UAE) or the United States (USA).

5. When Do We Start to Process Your Personal Data?

   1. We will start processing your personal data when we determine your country via IP address.
   2. Your personal data will not be collected and processed by us if you do not open the Site or any Internet page linked to the Game.

6. What Are the Consequences of Not Providing Personal Data?

   1. The provision of personal data is not a statutory or contractual requirement, as well as is not a requirement necessary to enter into a contract. You are free to refuse the processing of your personal data.

8. What Are Cookies and Other Tracking Technologies and Why Do We Use Them?

    3. We represent that we have concluded data processing agreements with all partners, which describe relevant technical and organizational measures taken by our partners to ensure the protection of personal data.
    4. The third-party suppliers that we use introduce technical and organizational measures to ensure secure processing of personal data, as specified in their privacy policies.
    5. We may disclose your personal data when required by law or legal process, or when we believe doing so will help to protect the safety, property, or the rights of individuals or Nekki. Examples include:
       • responding to a request from law enforcement, search warrant, or other valid legal inquiry;
       • responding to a court or other investigative body in the case of an alleged breach of an agreement or violation of law.
    6. We do not share your personal data with recipients who wish to use it for marketing purposes.

11. Do We Receive Personal Data from Third Parties?

    1. We may receive personal data from third parties, including Amazon Web Services Inc., Xsolla Inc., Helpshift Inc., Yandex.Metrica, Google Analytics, Google Ads, YouTube and Adjust.
    2. By accepting this Policy, you consent to our processing of personal data provided to us by third parties. At the same time, we guarantee that we will independently ask a third party as a source of personal data to confirm that it has correctly collected consent to the transfer of data to us.

    1. While using our Game, you may see links to third-party websites or applications. We would like to warn you that we are not liable for the services of third parties and their data collection processes, and do not control them.
    2. By clicking on the links, you may share your personal data with the third parties in accordance with their data processing rules.

13. Do We Transfer Your Personal Data to the Third Countries?

    1. In addition to your personal data processing in the United Arab Emirates (UAE), Nekki is going to transfer your personal data to the United States (USA).
    2. If we decide to implement a cross-border transfer of your personal data, Nekki will:
       • consider the level of protection, where personal data is transferred, including the legislation addressing personal data protection;
       • ensure that there is an applicable legal basis;
       • apply other appropriate measures to protect your personal data, if necessary (e.g. taking of reasonable cybersecurity measures and/or put in place the Standard Contractual Clauses, etc.).

14. How Do We Secure Your Personal Data?

    1. We are committed to protecting the security of your personal information. We use reasonable information security measures, including physical, administrative, and technical safeguards, including but not limited to, firewalls, antivirus and SSL encryption in order to protect your personal information from:
       • unauthorised access;
       • improper use or disclosure;
       • unauthorised modification or alteration;
       • unlawful destruction or accidental loss.
    2. Our employees and third parties are obliged to keep personal data confidential when accessing your data.
    3. We are constantly improving our data security systems and doing everything in our capacity to prevent its breach. In case such a breach occurs, we undertake to notify you and the regulators about the incident as quickly as possible, as well as to make every effort to minimize negative consequences.

    1. You have the right to do the following:
       • Withdraw your consent at any time. You have the right to withdraw consent where you have previously given the consent to the processing of your personal data. We guarantee you that it is as easy to withdraw as to give consent;
       • Object to processing of your personal data. You have the right to object to the processing of your personal data if the processing is carried out on a legal basis other than consent (more details are provided in the dedicated section 16 below);
       • Access your personal data. You have the right to learn if your personal data is being processed by Nekki, obtain disclosure regarding certain aspects of the processing (the purposes of the processing, the categories of personal data concerned, the recipients of your personal data, the period of personal data storage, etc.) and obtain a copy of the personal data undergoing processing;
       • Verify and seek rectification. You have the right to verify the accuracy of your personal data and ask for it to be updated or corrected;
       • Restrict the processing of your personal data. You have the right, under certain circumstances, to restrict the processing of your personal data. In this case, Nekki will not process your personal data for any purpose other than storing it;
       • Have your personal data deleted or otherwise removed. You have the right, under certain circumstances, to obtain the erasure of your personal data from Nekki;
       • Receive your personal data and have it transferred to another controller. You have the right to receive your personal data in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance;
       • Lodge a complaint. You have the right to bring a claim before your competent data protection authority.
    2. You may also exercise any rights provided for by the applicable data protection legislation. If you want to exercise one of the rights listed, please, contact us via details mentioned in clause 3.1 of this Privacy Policy.

16. What More Should You Know About the Right to Object to Processing?

    1. You may object to the processing of your personal data by providing a ground related to your particular case to justify the objection in the following situations:
       • where your personal data is processed for a public interest;
       • in the exercise of an official authority vested in Nekki;
       • for the purposes of the legitimate interests pursued by Nekki.
    2. You should know that if your personal data is processed for direct marketing purposes, you can object to that processing at any time without providing any justification. 17. How Can You Exercise the Rights You Have?

    1. Any requests to exercise your rights can be directed to us through the contact details provided in clause 3.1 of this Privacy Policy.
    2. Such requests can be exercised free of charge and will be addressed by Nekki itself or our DPO as early as possible and always within "1 (one) month".

18. Do We Carry Out the Automated Decision-Making, Including Profiling?

    1. Such a process is not hold by Nekki with your personal data.

19. How Do We Protect the Privacy of Children?

    1. Our Game is not directed to persons who are minors since they may not have sufficient legal capacity under the applicable legislation (usually, the laws of the country of your residence), and, therefore, we do not knowingly collect personal information from them.
    2. If you are a minor under the applicable laws of your country, please note that, in order to play our Game, you must:

22. Information for Game Users from the European Union (EU)

    1. We are relying on the European Union General Data Protection Regulation ("GDPR").
    2. The provisions of this section supersede any other possibly divergent or conflicting provisions contained in this Privacy Policy.

As the adequacy decision of the European Commission does not cover transfers from Nekki to US companies mentioned in section 12, it is considered that the transfer of your personal data is carried out to the country that does not ensure an adequate level of protection in terms of the GDPR. In this case, we use the standard contractual clauses (the "SCCs") under Article 46.2 of the GDPR.
